Cwphosting Terms of Service (ToS)

Introduction

Welcome to CWP hosting (“we,” “us,” “our”). These Terms of Service (“TOS,” “Terms,” “Agreement,” or “T & C”) govern your use of our website and all services, features, and content provided by CWP hosting. By ordering the one or multiple services from cwphosting, you declare that you have read, agree and understood to be bound by these terms of service. It is essential that you read this TOS before ordering any service(s) from CWP hosting.

Applicability

These terms of service apply to all the services provided by cwphosting to you throughout the entire renewal term. All customers must agree to all terms and conditions stated before signing up for any web hosting plans and services offered by cwphosting. We believe that you agree to apply only licenses and genuine third-party services & software in connection with your use of our services. Cwphosting reserves the right to cancel or suspend a user’s access to any services provided, at any time, or when cwphosting recognizes that the account is handled in inappropriate way or involved in any illegal activities.

Shared Hosting Plans

All terms and conditions outlined in this TOS apply to Shared Hosting plans, including but not limited to “Monthly Web Hosting,” “Single Domain Hosting,” “Multi Domain Hosting,” ” WordPress Hosting,” “Unlimited Web Hosting,” & “Reseller Hosting, etc.”

Abuse of Resources (Unacceptable Resource Usage)

In order to maintain the integrity of our servers and networks, we may conduct a verification process on your account. You may be asked to provide KYC (Know Your Customer) details, such as a clear scanned copy of your passport, driving license, or any other government-issued ID. The information on your ID should match the information on your account. Failure to verify this information may result in the cancellation of your account with no refund.

Prohibited Activities

  • Using Big Brand Names or Famous Brands Names for purchasing WEB HOSTING or DOMAIN NAME is strictly prohibited and is non-refundable.
  • Domain Name Changes: Only three domain changes are allowed for one hosting plan within one year.
  • Exceeding Resource Limits: If your cwp Panel or website exceeds resource limits, your account/website may be suspended. In this situation, you may need to upgrade your account to VPS or optimize your website content.
  • Phishing & Copyright Content: Hosting websites involved in phishing or hosting copyright-infringing content is strictly prohibited and non-refundable.
  • Hosting Content: Hosting of Mp3, Music, Video, and Movies File Websites or sites primarily for downloading content is allowed only on our VPS and Dedicated Server hosting plans.
  • Free Domains: While we allow the hosting of Free Domains or Freenom Domains (e.g., .tk, .cf), no refund will be provided for any cancellations or refund requests.
  • CPU Abuse or Overuse: CPU abuse or overuse (RAM/CPU) is not allowed, and accounts engaging in such activities may be suspended without notice.
  • Spamming/Bulk Email/Marketing Email: Spamming, bulk email, or marketing email is not allowed, and accounts engaging in such activities may be suspended without notice. Email usage limits apply (Max 30 emails per hour & total 60 emails per day).
  • Database Usage: Onohosting reserves the right to suspend or remove databases causing issues and downtime on our servers. Large and busy databases should be hosted on dedicated or VPS machines.
  • Resource Limit Exceeded: If your cwp Panel, or website exceeds resource limits, your account/website may be suspended. In such cases, you may need to upgrade your account or optimize your website content.

Unlimited Web Hosting Policy

  • Unlimited Disk Space: We do not set limits on bandwidth, websites, or disk space in the normal operation. However, cwphosting’s services are designed to meet the typical needs of small and medium-sized businesses and are not intended for the sustained demand of large enterprises. Prohibited uses include online storage, videos, images, audio, games, installers, executable files, backups, archiving of electronic files, documents, log files, web spiders, indexing, IRC, torrents, file sharing, peer-to-peer activities, testing environments, etc. Such prohibited use will result in the termination of hosting subscriber’s accounts, with or without notice.
  • Excessive Database Size: Accounts with excessively large databases (over 250MB) may negatively affect server performance. Cwphosting may request database size reduction or disable accounts with such large databases.
  • Database Creation: Hosting subscribers can create multiple databases, but the size of each database should not exceed 250MB. If your website’s database size exceeds 250MB, we recommend upgrading to VPS plans.

Server Uptime Policy

At Cwphosting, we strive to provide reliable hosting services and minimize downtime to ensure an optimal experience for our customers. Please familiarize yourself with our Server Uptime Policy:

Uptime Guarantee

We understand the importance of website and server uptime. While we make every effort to maintain uninterrupted service, we do not offer specific uptime guarantees such as 99% or 98%. These percentages are references, and we do not provide compensation for server downtime.

Service Interruptions

  1. Scheduled Maintenance: Any service interruptions or downtime resulting from scheduled maintenance conducted by Cwphosting or our network providers will not be considered as downtime for the purpose of our uptime guarantee. We may perform server, software, and tool upgrades periodically to enhance performance and security. During such maintenance, customers may or may not be notified 24 hours in advance. Downtime during these upgrades typically lasts between 10 to 48 hours.
  2. Third-Party Services: Cwphosting is not liable for the failure of third-party services, including but not limited to DNS propagation, which may impact your website’s accessibility.
  3. Force Majeure: Cwphosting will not be held liable for failure or delay in performing its obligations if such failure or delay results from circumstances beyond our reasonable control. These circumstances may include acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike, or other labor disturbances, interruptions in transportation, unavailability of or delays in telecommunications or third-party services, failure of third-party software or hardware, or the inability to obtain raw materials, supplies, or power necessary for the provision of services.

Responsibility

You, as our valued customer, are responsible for utilizing our services wisely and in accordance with our Terms of Service. We encourage you to take necessary precautions, such as regular backups, to safeguard your data and ensure a smooth experience.

While we aim to maintain optimal uptime and provide quality service, please understand that our servers involve various third-party software, network connections, and hardware components, making occasional issues possible. You acknowledge that Cwphosting is not responsible for website, application, or server uptime.

Data Backup Policy (Shared Hosting)

Applicability

This Data Backup Policy applies to Shared Hosting plans, including but not limited to “Monthly Web Hosting,” “One Domain Hosting,” “Multi Domain Hosting,” “WordPress Web Hosting,” “Unlimited Web Hosting,” & “Reseller Hosting.”

Backup Services

At Cwphosting we understand the importance of data backup for our customers. Here’s how our backup services work:

  1. Free Monthly Backups: Cwphosting conducts server backups every 30 days, generating one backup copy per month. The free backup service creates backups on random days and replaces the previous backup with each new run, retaining only one backup at a time. While we strive for accuracy, there is a slight chance (approximately 1% to 2%) of errors during the scheduling or backup process due to technical reasons and the volume of customer accounts. In such situations, Cwphosting may not be able to provide the free backup. Therefore, your use of our services is at your own risk.
  2. User Responsibility: You agree to back up all of your User Content so that you can access and use it when needed. Cwphosting does not guarantee the backup of any account or User Content. You acknowledge the risk of potential data loss, and Cwphosting is not responsible for any data loss or data corruption under any circumstances.
  3. Paid Backup Service: Clients who have subscribed to the paid backup service with shared and reseller hosting plans receive website backups every 15 days.
  4. Cwp Backup Manager: Clients using the cwp Backup Manager tool for backups should download their backups from the server and delete them. Every 10 days, all backup files are removed from the server without prior notification. Please refrain from using hosting space to store backups.

Important Note

  • Cwphosting strongly advises users to maintain their backup copies of hosting accounts to prevent data loss in the event of account termination. Once your web hosting account is terminated, all your files and data will be deleted from the server. Cwphosting will not be liable for any data loss in this scenario.

While we take precautions to safeguard your data, including providing backup services, the responsibility for data backup ultimately rests with you, the user. We recommend regular data backup practices to ensure the security and availability of your content.

Third-Party Software Policy

Configuration and Setup: Cwphosting does not provide assistance or support for the configuration or setup of third-party software, including but not limited to webmail services, G Suite, Outlook, Zoho Mail, etc. It is the responsibility of the user to configure and set up such software independently.
  2. Responsibility for Third-Party Software: Cwphosting is not responsible for the functionality or performance of any third-party software, scripts, or code used by our customers. Users cannot hold us accountable for any issues related to scripts or code that work on different servers or hosting providers but may not function correctly on Cwphosting’s servers. In such situations, customers should contact their code provider or developer for assistance (No Refund).

Pricing Changes

  1. Third-Party Software License Pricing: Cwphosting’s pricing may be subject to changes in response to fluctuations in the pricing of third-party software licenses. This includes software such as Softaculous, CloudLinux, LiteSpeed, Plesk, and others. In the event of price increases or decreases for these third-party licenses, Cwphosting reserves the right to adjust its pricing accordingly. Customers will be notified of any such changes as applicable.

Web Hosting Control Panel and Software Changes

  1. Control Panel and Software Changes: Cwphosting reserves the right to change the web hosting control panel and associated software at any time. This may include updates, migrations, or transitions to different control panel solutions. We aim to ensure a seamless transition and minimal disruption to our customers during such changes.

Content Strictly Prohibited

All services provided by Cwphosting must be used for lawful purposes only. Users are strictly prohibited from engaging in activities that violate applicable laws and regulations. Prohibited activities include, but are not limited to, the following:

  1. Illegal Activities: Transmission, storage, or presentation of any information, data, or material in violation of any applicable law or regulation is strictly prohibited.
  2. Malicious Software: Using our services for activities related to E-Gold, proxies, bots, spam bots, mail bombers, port scanners, IP scanners, mail harvesting scripts, brute force scripts, or any malicious software is not allowed.
  3. Unlawful Sales: Sales of illegal pharmaceuticals, drugs, explosives, anonymous or bulk SMS gateways, or any illicit products are strictly prohibited.
  4. Illegal Content: Hosting content related to malware, warez, phishing materials, IRC hosts, Satta, lottery, gambling, illegal downloads, IRC bots, Autobots, pirated software, ROMs, emulators, cracked or nulled themes or plugins, phreaking, hacking, password cracking, IP spoofing, human trafficking, child pornography, or any explicit or illegal content is not allowed.
  5. Copyright Violation: Distribution of copyrighted software, songs, MP3s, or any other pirated content, as well as streaming or broadcasting of live copyrighted events, is prohibited.
  6. Defamatory Content: Hosting websites with content that defames any person, religion, community, organization, or entity is strictly prohibited.

Gaming: We do not allow the hosting of any kind of games on our servers. Hosting accounts found with gaming-related content will be immediately terminated. (Gaming is allowed only in VPS Hosting).

Database Servers: Database servers must be used exclusively from our web servers. We do not offer database hosting for use with other web servers or desktop applications. For hosting with desktop applications or remote database connectivity, please contact our sales team for customized plans.

Resource-Hungry Scripts: If a website script is found to be resource-hungry or problematic, it may be stopped, and the customer will be notified via email. Customers can resolve script issues, and with the approval of our technical team, scripts may be allowed to run on our servers.

Domain Policy & Payments

No Refunds for Registered or Activated Domains

Once a domain is registered or activated, no refunds are applicable. We encourage users to make domain registration decisions carefully.

Domain Infringement

  1. Trademark Infringement: Users are prohibited from registering domain names that are similar to any trademarked domain or domain closely resembling any established brand or business providing similar products and services. Attempting to purchase or register such domain names constitutes trademark infringement. For example, domains like Flipkartstore.xyz, adtyabrlasfnanc.in, or bajajfinancecs.com will be suspended, and no refunds will be issued.

Domain Renewal

  1. Renewal Reminders: We will send you invoice reminders for domain renewal one month or one day before the expiry date. However, we are not responsible for any failure or delay in renewing domain names. Once a domain is successfully renewed, no refunds will be provided.

Purchased Domain Not Active or Available

  1. Technical or API Issues: In rare cases, due to technical issues or domain registrar API problems, domains that have already been purchased or premium domains may appear available for purchase by customers. If a customer buys or initiates payment for such a domain, and the domain cannot be activated, the customer has two options:
    • Alternative Domain: The customer can provide us with an alternative domain name with the same extension. We will activate the new provided domain name without any additional charges.
    • Refund: If the customer does not wish to provide an alternative domain name, they can request a refund within 24 hours of purchase.

Premium Domain Names and Special Characters

  1. Premium Domains: We do not sell or provide premium domain names.
  2. Special Characters: We do not provide domain names with special characters, such as “ß,” “σ,” “ἀ,” etc., to ensure compatibility and ease of use.

Late Payment or Non-Payment or Invoice Policy

At Cwphosting, we value your business and aim to provide uninterrupted services. Please review our Late Payment and Invoice Policy for important details:

Unpaid Invoices

  1. Suspension: Failure to pay invoices on time may result in the suspension of the hosting account on the last due date.
  2. Termination: If an account remains suspended, termination (deletion of all hosting-related account data) will be executed within the next 7 days following the suspension. Once an account is terminated, data residing on it will not be restored and will be treated as a new account.

Note: Cwphosting will not be responsible for the loss of user website data if an account is terminated due to non-payment. We strongly urge users to renew their services on time to avoid data loss.

  1. Outstanding Balance: We will not activate new orders or new packages for customers who have an outstanding balance on their account.

Expired Monthly Hosting Plans

For Monthly Hosting Plan users, please take note of the following:

  1. Renewal Deadline: Renew your monthly hosting plans on or before the due date. You will have a grace period of 7 days to renew a suspended hosting account. After this period, Cwphosting will not be responsible for any data loss.
  2. Activation Period: If you pay the renewable invoices for a suspended account, e.g., 10 or 20 days later, services will be activated from the invoice creation date to the invoice expiration date. Cwphosting recommends purchasing yearly hosting plans to avoid such situations.

Renewal of Business Email Services (Office 365 & G Suite)

For users of Business Email Services, please note the following:

  1. Renewal Deadline: Users must pay their renewable invoices at least 10 days before the due date.
  2. Service Suspension: Additionally, we will stop email services 5 days prior to the due date (email expiry date) to ensure smooth operation. Since these services are third-party, we must pay their bills in advance.

Refusal of Service
